Strong advocacy for Palo Alto law enforcement officers when employers discriminate

Law enforcement officers risk their lives for us. At McNicholas & McNicholas, LLP, we work to ensure that employers don’t risk their careers. It’s illegal to discriminate against, harass, or retaliate against police officers, sheriff’s officers, and other law enforcement officers by affecting their employment in any way- based on their race, gender, disability, or other identity characteristics. Our Palo Alto employer lawyers file actions in federal and California courts and agencies when police departments and other law enforcement employers discriminate. We file retaliation claims when employers punish or try to intimidate officers who assert their legal rights. We demand payment of all the compensation and benefits you deserve based on your contracts, federal law, and California law.

We’ve helped the employees we represent obtain more than $150 million in recoveries. Some of our police officer settlements and verdicts include:

What conduct qualifies as police officer employment discrimination?

Our Palo Alto employer lawyers file an employment discrimination claim for police officers when the following conditions apply:

  • The officer is eligible. If a Palo Alto law enforcement officer (police officer, sheriff’s deputy, or some other law enforcement officer) is an employee. In some cases, independent contractors may also be able to file a discrimination claim.
  • The officer’s employment status is adversely affected. Examples include being fired, not getting a promotion, being assigned undesirable tasks, being transferred to an undesirable location, pay decreases, and other actions.
  • The employee is a member of a protected class. Protected classes include race, national origin, color, relegation, age, disability, pregnancy, military status, and other factors depending on which law applies.

Examples of employment discrimination in Palo Alto include:

  • Workplace harassment

  • Not being given the same opportunities as other workers

  • Quid pro quo harassment. Conditioning employment opportunities on sexual favors.
  • A hostile work environment. You may have a sexual harassment claim if your employment involves listening to offensive sexual conversations and jokes, viewing sexual images, and other inappropriate sexual conduct. You can file a workplace sexual harassment claim even if you are not the focus of the offensive sexual conduct.

Sexual harassment at work is generally considered sex discrimination.
